U.S. District Court Judge Aileen Cannon will not block release of special counsel Jack Smith’s report of President-elect Donald Trump’s alleged effort to overturn 2020’s election results, according to multiple reports.

“Based on these representations, the Court sees an insufficient basis to grant emergency injunctive relief as to Volume I,” the Florida judge wrote. Advertisement

Cannon’s five-page ruling on Monday also denied attempts by Trump and co-defendants Walt Nauta and Carlos De Oliveira from blocking the release of two volumes of the report in the Mar-a-Lago classified documents case.

On Tuesday, Cannon, 44, initially agreed to block release of both reports for a three-day period while the 11th U.S. Circuit Court of Appeals reviewed an emergency motion to block it.

Days later on Friday, Smith resigned from the Justice Department as expected after he finished work on the two cases against the former and future U.S. president.

A Trump-appointee, Cannon oversaw the classified documents case against Trump and ruled last summer to dismiss the case, believing that Smith’s appointment violated the Appointments Clause of the U.S. Constitution.

But Monday’s ruling arrived a week before Trump is to be sworn in as president. Advertisement

Trump was indicted on four felony charges related to the incident, but those charges were dropped after he won the 2024 election in November.

Meanwhile, Cannon has scheduled a hearing on Friday to address part of Smith’s report involving his classified documents probe at Trump’s Florida estate, according to CNN and The Hill.
